RE: The tariff classification of tablecloth weights from Taiwan and China

Dear Ms. Ramsey:

In your letter dated August 6, 2008, you requested a tariff classification ruling. Photographs of the items were submitted for our review.

The merchandise consists of three styles of tablecloth weights that will be used indoors or outdoors to keep tablecloths from sliding or blowing off a table. The first two sets are made of pewter animal weights with steel clips attached by a metal link. Item number 66080 is identified as Sea Creatures and contains a lobster, turtle, starfish and seahorse. Item 66082 is identified as Farm Animals and includes a rooster, duck, pig and sheep. The third set of four tablecloth weights is described as Faux Diamond, item number 66470. Each consists of a multi-faceted glass imitation diamond attached by a short chain to a chrome-plated steel clip. The value of each item within the set is less than $3.00. The applicable subheading for the Sea Creatures and Farm Animals tablecloth weights will be 8007.00.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of tin, articles not elsewhere specified or included of a type used for household, table or kitchen use; toilet and sanitary wares; all the foregoing not coated or plated with precious metal, other. The rate of duty will be 2.1 percent ad valorem.

The applicable subheading for the Faux Diamond tablecloth weights will be 7013.49.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…glassware of a kind used for table (other than drinking glasses) or kitchen purposes other than that of glass ceramics, other, other, valued not over $3 each. The rate of duty will be 22.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
